Updated WHS Regulations

In 2019 the model WHS Act and Regulations were independently reviewed. From this review SafeWork Australia published updated WHS Regulations in June 2022.

In NSW, these amendments to the model WHS Regulations were then passed on 19 September, 2022 and will come into effect from 1 October 2022.

What are the main changes to the Regulations that impact your venue?

The Regulations set clear directions that you cannot insure against your WHS obligations. This means you cannot take out insurance to cover for any WHS related penalties issued under the Act.

For the first time ever – provisions of Psychosocial hazards and controls to mitigate risk. Historically the Act and Regulations only reference psychological health once and that was in the Act’s definition of “health.” Now the Regulations have an entire chapter devoted to psychosocial hazards and responsibilities to mitigate risk.

What does this mean for your venue?

The main and critical focus of these changes is the area of psychosocial hazards and controls to mitigate the risk. What this means is that, PCBU’s will have a greater responsibility to identify, assess, control and review their risks in the psychosocial space to reduce risk of psychological injuries.
